Bilindiği gibi Kıbrıs Cumhuriyeti (KC) idari mahkemesi 1974 sonrası doğan ve ebeveynlerinden biri Türkiye Cumhuriyeti (TC) kökenli olanların KC vatandaşlığı alma hakkına sahip olmadığına karar vermiştir.
Açıktır ki, daha önce mülkiyet konularında halkların çıkarlarını göz ardı ederek ve insan haklarını göz önünde bulundurduğunu iddia ederek, bireysel mülkiyet hakları doğrultusunda kararlar üreten KC hukuk sistemi ve mahkemeleri; vatandaşlık konusunda bireysel hak ve özgürlüklerden, insan haklarından ziyade devletin çıkarlarını korumayı düşünen siyasi bir karar almıştır.? Adamıza Kıbrıs’ın kuzeyinden giriş yapanların Kıbrıs Cumhuriyeti’ne “yasa dışı yolla” geldiğini kabul etsek bile; hukukta, ebeveynlerin tercih, davranış veya suçlarından çocukların sorumlu tutulması ve çocukların hak ve özgürlüklerini ebeveynlerin hareketlerinin belirlemesi, etkilemesi “çağdaş hukuk normları” göz önüne alındığında kabul edilebilir değildir.
Bu tür uygulamalar ve kararlar ancak, demokrasinin olmadığı baskıcı, faşizan rejimlerde kendine yer bulabilir.?Belirtmek isteriz ki, mahkemenin almış olduğu bu siyasi karara karşı, AKEL gibi her fırsatta Kıbrıslı Türklerle ortak Federal bir devlette yaşamak istediğini söyleyen Kıbrıslı Elen ilerici güçlerinin sessiz kalması; bölünmüş adamızın her iki yarısında şoven ve milliyetçi unsurları daha da cesaretlendirirken, halkların kardeşleşmesi mücadelesine de darbe vurmaktadır.
Öte yandan, adamızın yeniden birleşmesi için mücadele verme iddiasıyla halkımıza önderlik etmeye soyunan Kıbrıslı Türk ilerici güçlerinin sessizliği ise halkımızın güven kaybına uğramasına, sol ve ilerici güçlerden uzaklaşmasına yol açarken, pusuda bekleyen sağ cenahın barış karşıtı propagandalarına da uygun zemin hazırlamaktadır.
Bizler, bağımsız ve halkları kardeş bir Kıbrıs için mücadele edenler, TC egemenlerinin sosyal, ekonomik, siyasal ve kültürel baskılarına karşı yıllardır direnen halkımızın, KC mahkemelerinin “devletin bekası” adına aldığı siyasi kararlarla “vatandaş olanlar” ve “olmayanlar” diye bölünmesine izin vermeyeceğiz.
Nereden gelirse gelsin, Kıbrıslı Türk halkının mücadele birliğini bozan uygulama ve yasalara karşı direneceğiz.

WE WILL NOT ACCEPT A PARTITION IN OUR COMMUNITY JUST BECAUSE OF REPUBLIC’S INTERESTS
As it is known, Administrative Court of the Republic of Cyprus (RC) ruled that people living in the north of Cyprus who were born after 1974 and whose one of their parents have a Republic of Turkey (TR)-origin, will not have the right to be a citizen of the RC.
It is very obvious that, the judicial system and the courts of the RC, which took decisions in favour of personal proprietary rights ignoring the public interest and human rights before, has done another similar mistake and ruled about this citizenship issue that will benefit the interest of the Republic but not the human rights and freedoms.
Even if we agree that people who have entered our island through the north of Cyprus and entered the RC, are following an “illegal way”; but considering the contemporary law norms, it is never acceptable to regard the children of these people as responsible from what they did; children can not be accused or punished because of their parents’ behaviour and offenses. These kind of practices can only be seen in antidemocratic, oppressive regimes.
Greek Cypriot progressive organisations, like AKEL, who repeat that want to live together with Turkish Cypriots at every turn, are heavily silent against this political decision of the RC-court. We have to state that, this silence is encouraging the chauvinist and nationalist groups as well as effecting the brotherhood/sisterhood struggle of the two communities in a negative way.
On the other hand, the silence of the Turkish Cypriot organisations who claim that they are struggling to reunite the island and try to lead the community, make Turkish Cypriots lose confidence towards them and recede from all leftist and progressive forces, creating a suitable environment for the rightist flank to empower their anti-peace propaganda.
We, as the ones who are struggling for an independent Cyprus and for the brotherhood and sisterhood of the people all around the island, will not let a partition in our own community who is fighting for their unity against the social, cultural, economic and political oppressions and exploitations imposed by TR hegemonic powers for years. We will not let the decision of the RC-court –taken for the sake of republic’s good(!)- to divide our community into “ones who are citizens” and “ones who are not”. Whereever it comes, we will resist the practices and laws which try to destroy the unity of the Turkish Cypriot community in the struggle. We will resist the elements who try to divide Turkish Cypriot community and wipe them off from the history.
